Yarraguntla.Koteswara Rao,Standing Counsel For Zilla Praja Parishads,Mandal Praja Parishads and Gra 4. 3 HBKM,J W.P.No.8337 of 2021 The Court made the following Order:- Heard the learned counsel for the petitioner, the learned Standing Counsel for the 3rd respondent and the learned Standing Counsel appearing for the respondent Nos.6 and 7. 2. This writ petition was filed questioning the action of the respondent Nos.3 and 4 in not taking any action to conduct the survey to protect the Mandal Parishad Upper Primary School in an extent of Ac.0.24 cents in R.S.No.91-3 situated at Prodduvaka Village, Mudinepalli Mandal, inspite of making representation dated 31.03.2021. 3. On the other hand, the learned counsel appearing for the respondent Nos.6 and 7 relying upon the counter of the 6th respondent submits that the Mandal Parishad Upper Primary School, Bobbiligudem is located in the hamlet of Prodhuvaka Village, Mudineaplli Mandal of erstwhile Krishna District. The said school is having Ac.0.24 cents and the said school was established in the year 1965. As the school is not having any compound wall, the Grampanchayat passed the resolution to construct the compound wall around the school building as per the resolution No.34 dated 16.12.2019 to protect the school. The then District Collector, erstwhile Krishna District issued the Administrative sanction for construction of the compound wall in length 75 meters with an estimated cost of Rs.4,41,189/- vide proceedings dated 23.01.2020. 4 HBKM,J W.P.No.8337 of 2021 4. As per the request of this petitioner to the Grampanchayat, the Mandal Surveyor, Mudinepalli, carried out the survey and stated that the compound wall was constructed covering an extent of Ac.0.16 cents and the remaining land was left over for road to facilitate the School Children to have access to the main road. The left over land was under possession of the said school and there are no encroachments by the villagers. 5. The learned counsel appearing for the 3rd respondent relying upon the counter of the 3rd respondent submits that while constructing the compound wall, some part of the land was left to the margins of the compound wall, as the public road is so congested causing hindrance to the free movement of the vehicles. Hence, some portion of the land was left over to have free movement for the school children and the other villagers but not occupied by any of the village encroachers as alleged by the petitioner. 6. In view of the above said facts and circumstances, no further orders are necessary in this writ petition. 7. Accordingly, this Writ Petition is disposed of. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
