The present petition has been filed by the petitioner with the following prayer: "(1) issue a writ, order or direction in the nature of MANDAMUS directing the opposite parties for removal of illegal encroachment of Chak Marg No. 1348/0.019 hectare, situated in Village-Atsaliya, Pargana and Tahsil-Sandila, District-Hardoi, which is entered as Gata No. 1348 in revenue records, within an specific time period, frame as this Hon'ble Court may deem fist just and proper (contained as Annexure No. 1 of this petition)." 2. Learned Standing Counsel based upon the instructions states that no encroachment exists on the said road as alleged. 3. In view thereof, the present petition is disposed of. In case any encroachment exists, the petitioner would have remedy under Section 26 of the U.P. Revenue Code, which shall be decided in accordance with law.
