No.271/1, Thimmapuram Village, Samarlakota, EG District is concerned, taking into the law in WP No.3079/2017 dated 07.02.2019 and WP No. 12737/2003 Dated 21.11.2003 by this Honourable High Court IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents, particularly 3rd respondent not to interfere with petitioner / family members personal life, liberty and property in so far as it relates to 244 sq. yards in LP No.245/1991 of Sy. yards in LP No.245/1991 of Sy. No.271/1, Thimmapuram Village, Samarlakota, EG District without following due process of law as per the law rendered in WP No.3079/2017 dated 07.02.2019 and WP No. 12737/2003 Dated 21.11.2003 by this Honourable High Court is concerned, pending disposal of writ petition. Y V SATYANARAYANA THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 8638 of 2020 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a writ order or directions more in the nature of writ of mandamus under Article 226 of the Constitution of India declaring the action of the 3rd respondent in harassing the petitioner / his family members with dire consequences and threatening members life and property to do with petitioner / family apart from interfering undue favor to the party respondent in so far as it relates land 244 sq yards in LP.No.245/1991 of Sy.No.271/1, Thimmapuram Village, Samarlakota, EG District is concerned as arbitrary illegal malafide violating Articles 14, 19 and 21 of the Constitution of India and issue consequential directions directing the respondents particularly the 3rd respondent not to interfere with petitioner/family members life liberty and property in so far as it relates to 244 sq yards in LP.No.245/1991 of Sy.No.271/1 Thimmapuram Village Samarlakota EG District is concerned taking into the law in W.P.No.3079/2017 dated 07.02.2019 and W.P.No.12737/2003 Dated 21.11.2003 by this Honourable High Court and pass.…” 2. None represented for the petitioner. 3. Sri Y.V.Satyanarayana, learned counsel for unofficial respondent would submit that the subject matter is purely civil in nature and the petitioner intend to convert the same into criminal case. 4. Sri V.Farooq, learned Assistant Government Pleader for Home for the official respondents on written instructions would submit that the police are not interfering with the civil disputes between the petitioner and the unofficial respondents and the Court may pass appropriate orders. 5. Recording the above said submissions, the Writ Petition is disposed of. However, the parties are at liberty to workout their remedy before the appropriate forum according to law. There shall be no order as to costs.
