Court No. - 5 Case :- WRIT - A No. - 1116 of 2025 Petitioner :- Keshav Respondent :- State of U.P. and Another Counsel for Petitioner :- Satyendra Kumar Mishra Counsel for Respondent :- C.S.C.,Vibhanshu Vaibhav Hon'ble Ajay Bhanot,J. Heard Shri Satyendra Kumar Mishra, learned counsel for the petitioner and Shri Vibhanshu Vaibhav, learned counsel for the respondent and learned Standing Counsel for the State. The father of the petitioner died on 13.02.2010. The petitioner claims to have moved an application before the respondent authorities for the first time in the year 2010, thereafter in the year 2013 and lastly on 22.11.2024. The petitioner has approached this Court almost 14 years after the first application was filed. The writ petition is liable to be dismissed on ground of delay and laches. Filing of representations does not condone the delay. Moreover, a long delay in pressing the claim for grant of appointment on compassionate ground leads to an inference that the financial penury caused by death of the employee does not exist. The writ petition is dismissed. Order Date :- 5.2.2025 Vandit Digitally signed by :- VANDIT AGRAWAL High Court of Judicature at Allahabad
