Heard the learned counsel Mr. D J Haloi appearing for the petitioner. Also heard Mr. K K Das, the learned Additional Public Prosecutor appearing for the State of Assam.
2. This is an application under Section 483 of the BNSS, 2023 praying for grant of regular bail in respect of Rangapara GRPS Case No. 05/2025.
3. Mr. Das submits that the case diary has not been received.

4. Mr. Haloi submits that the offence alleged in the FIR is a 60 days offence and the petitioner has spent 62 days in custody. The offences for which the petitioner was arrested stipulates the maximum period of detention of 60 days.
5. For the aforesaid reasons, this Court has decided to consider the bail application today.
6. Intermediate quantity of ganja was recovered from the possession of the petitioner. According to the petitioner, his wife is suffering from cancer and some medical documents to that effect have also been filed.
7. I have considered the submissions made by the learned counsel of both sides.
8. The petitioner has already spent 62 days in custody, whereas the mandatory period of detention is 60 days. Moreover, the wife of the petitioner is suffering from cancer. Therefore, the bail application filed by the petitioner is allowed.
9. It is hereby directed that the petitioner Bhanu Ram Kalita, who was arrested in connection with Rangapara GRPS Case No. 05/2025, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of learned Special Judge, Sonitpur, Tezpur, Assam. The bail application is disposed of accordingly.
