Also heard Mr. Z.H. Bora, learned counsel appearing for the opposite party no. 3. This I.A. has been filed seeking impleadment of the opposite parties as respondents in Contempt Case (C) No. 504/2021. It is submitted that respondents No. 1, 2 & 3 in the said contempt case have since demitted office. Accordingly, the present opposite parties — namely, Shri Rajesh Kumar Singh, IAS, Defence Secretary, Government of India; Shri Rakesh Mittal, Joint Secretary (BRO), Ministry of Defence; and Shri Lt. General Raghu Srinivasan, VSM, Director General of Border Roads — are sought to be impleaded as respondents No. 4, 5 & 6 in Contempt Case (C) No. 504/2021. The prayer made in the I.A. is not objected to by Mr. Z.H. Bora, learned counsel appearing for respondents No. 1, 2 & 3 in Contempt Case (C) No. 504/2021. Considering the submissions of the learned counsel for the petitioner that the present opposite parties No. 1, 2 & 3 are now holding office in place of the respondents No. 1, 2 & 3, this Court finds it appropriate to allow the I.A. In that of the above and taking into consideration the submissions made, this Court is of the view that the prayer for impleadment of opposite party Nos. 1, 2 & 3 can be allowed at this stage. The opposite party Nos. 1, 2 & 3 when impleaded as respondents in Cont.Cas(C) No. 504/2021 will get sufficient opportunities to file their counters. Accordingly, the Interlocutory Application Page No.# 3/3 stands allowed, the opposite party Nos.1, 2 & 3 are therefore, arrayed as respondent Nos. 4, 5 & 6 in Cont.Cas(C)/504/2021. The applicant will file amended cause title before the Registry within 2 (two) weeks from today. Accordingly, this Interlocutory Application is disposed of. JUDGE Comparing Assistant
