Heard. Perused Annexure-10. We fail to understand as to how such a query could be put as is contained therein if there is a will executed, which is duly registered, by the petitioners' father, who was the owner of the premises in question and as per the said will, he has bequeathed the same to his two sons, who are petitioners herein. On being confronted, learned counsel for Lucknow Development Authority could not satisfy us in this regard. Let respondent No.2 look into the matter as to the entitlement of the petitioners to be mutated in respect to the premises in question consequent to the death of their father, in the light of the will being relied by the petitioners and subject to its veracity and do the needful as per law at the earliest say within two months, unless there is any legal impediment, in which case the petitioners shall be informed in writing. It shall also be ascertained as to whether the will has been challenged by any person. It is made clear that we have not adjudicated the ownership of the petitioners in respect of premises in question, but we have only directed the respondent No.2 to get the facts verified and do the needful as per law within the aforesaid period.
