Court No. - 4 Case :- CONTEMPT APPLICATION (CIVIL) No. - 347 of 2025 Applicant :- Maya Ram Opposite Party :- Sri Padmesh Srivastava, Tehsildar Tehsil Jalalpur Distt. Ambedkar Nagar Counsel for Applicant :- Babu Ram Hon'ble Rajnish Kumar,J. Heard Sri Babu Ram, learned counsel for the applicant. This application has been filed alleging non compliance of the
order dated 17.05.2024 passed in Matters Under Article 227 No.2447 of 2024(Maya Ram versus State of U.P. and others). This Court by means of the aforesaid order had granted liberty to the petitioner to move urgency application, which has been
directed to be decided after giving opportunity of hearing to parties concerned expeditiously. The operative portion of the
order is extracted herein-below:-
"On the request of learned counsel for the petitioner and without entering into the merit of the case, the present petition is disposed of with liberty to the petitioner to move an urgency application in Case No. T202104040204948 titled as 'Maya Ram vs. Naresh' filed under Section 34 of the U.P. Revenue Code, 2006, relating to Mauja Bhadoi/Sahajitpur, Tehsil Jalalpur, District Ambedkar Nagar, which is pending since 11.10.2021 before respondent no. 2. If any such urgency application is preferred, it is expected that respondent no. 2 shall decide the urgency application expeditiously in accordance with law, after giving opportunity of hearing to the parties concerned and without providing any unnecessary adjournment to either of the parties"
Learned counsel for the applicant submits that he has moved an application on 31.05.2024, a copy of which has been placed on record as Annexure No.2. Annexure No.2 annexed with the application indicates that it is not an urgency application and it is only an application serving a copy of the order passed by this Court. In view of above, since no application for urgency has been moved, no contempt can be alleged against the authority concerned. The application is mis-conceived. Dismissed.
