ORDER Date : 13-10-2025 Heard Mr. S.Z.B. Aklas, learned counsel for the petitioner and Mr. D. Borah, learned Junior Government Advocate, Assam for the respondent nos. 1, 2, 3 & 4. 2. The petitioner as the wife of one Late Md. Hussain [since deceased], an employee of Mangaldoi Municipal Board, sought relief under the Assam
Page No.# 3/5 Employees Parents Responsibility and Norms for Accountability and Monitoring Act, 2017, which is, in short, also known as Assam Employees PRANAM Act,
2017. The ground for seeking relief was that after Md. Hussain, during his lifetime took voluntary retirement from his service in the year 2015, expired in the year 2017 and in acknowledgement of his death, his elder son, that is, the respondent no. 7 was appointed in the service of the Mangaldoi Municipal Board as an electrician. 3. The petitioner being the widow of Late Md. Hussain and the mother of the respondent no. 7, had raised a grievance that the respondent no. 7 did not provide any amount for the maintenance of the petitioner. With such grievance, the petitioner submitted an application on 13.12.2023 before the Mangaldoi Municipal Board praying for deduction of an appropriate amount from the salary of the respondent no. 7 for her maintenance. When the said application under the Assam Employees PRANAM Act, 2017 was not disposed of by the Designated Authority in the Mangaldoi Municipal Board, the petitioner approached this Court by way of a writ petition, W.P.[C] no. 801/2024. This Court having examined the provisions contained in Section 11 of the Assam Employees PRANAM Act, 2017 about the remedy of preferring an appeal against such non-disposal of application, disposed of the writ petition by an Order dated 26.02.2024 granting liberty to the petitioner to approach the Appellate Authority by way of an appeal under Section 11 of the Assam Employees PRANAM Act,
2017. In view of the appellate remedy available under Section 11 of the Assam Employees PRANAM Act, 2017, the writ petitioner withdrew the writ petition to prefer an appeal under Section 11 of the Assam Employees PRANAM Act, 2017. 4. Thereafter on 14.03.2024, the writ petitioner preferred an appeal under
Page No.# 4/5 Section 11 of the Assam Employees PRANAM Act, 2017 before the Directorate of Municipal Administration, Assam. 5. Mr. Borah, learned Junior Government Advocate, Assam has placed a copy of the Order issued under Memo no.
M.M.B.1167/2024/9679[A] dated 16.08.2024 passed by the Executive Officer, Mangaldoi Municipal Board to submit that the Designated Authority in the Mangaldoi Municipal Board had already passed an Order directing payment of 10% from the salary of the respondent no. 7 @ 1,100/- per month for deposit of the said amount in favour of the petitioner. A direction has been made to deposit the said amount in the bank account of the petitioner every month. 6. From the contents of the Order dated 16.08.2024, it appears that the
Order dated 16.08.2024 appears to have been passed on consensus.

This writ petition has been preferred with a grievance that the appeal preferred by the petitioner under Section 11 of the Assam Employees PRANAM Act, 2017 was not disposed of by the Appellate Authority, that is, the respondent no. 3. The petitioner also sought for a direction to the respondent no. 3 to dispose of the appeal preferred under Section 11 of the Assam Employees PRANAM Act, 2017.
8. Mr. Atlas, learned counsel for the petitioner has submitted that the petitioner has been receiving the sum of Rs. 1100/- every month in her bank account.
9. In view of the Order dated 16.08.2024, the purpose of preferring the appeal before the respondent no. 3 has become redundant and consequently, the present writ petition. If the petitioner has any further grievance with regard
Page No.# 5/5 to the Order dated 16.08.2024, the petitioner has remedy under the Assam Employees PRANAM Act, 2017.
10. In view of the above discussion and taking note of the submissions made by the learned counsel for the parties, this writ petition stands closed.
