The three petitioners/accused were arrested on 13.03.2025 for the offence punishable U/S : 8(c)/22(c)/23/25/29/35 ND & PS Act and were produced before the Ld. Duty Magistrate, Thoubal on 14.03.2025, thereby vide order dated 03.04.2025, the applications filed under Section 37 of ND & PS Act read with Section 480 of BNSS, 2023 praying for releasing on bail were rejected in Cril. Misc.(B) Case No. 63 of 2025, 64 of 2025 and 65 of 2025, since the cases were involved in recovery of commercial quantity of contraband item and further investigation is required. Mr. Ch. Special Judge, Thoubal opined that the application is for remand and therefore, rejected for passing any order on merit. It is also submitted that the matter be remanded to the Ld. Special Judge, Thoubal for passing an appropriate order under Section 37 of ND&PS Act read with Section 480 of BNSS, 2023. Mr. Boboy Potsangbam, learned CGSC and Mr. Kamikumar, learned CGSC appearing for the respondent has no objection in remanding the matter to the Ld. Special Judge (ND & PS) for passing an appropriate order on merit under Section 37 of ND & PS Act read with Section 480 of BNSS, 2023. Accordingly, matter be remanded to the Ld. Special Judge(ND & PS), Thoubal to hear the parties on merit of the bail application and pass a speaking order. Cril. Misc. (B) Case No. 63 of 2025, 64 of 2025 and 65 of 2025 are restored to the file of the Ld. Special Judge (ND&PS), Thoubal for consideration on merit.
