1. Heard learned counsel for the petitioner. 2. Notice on behalf of the respondent no.1 has been accepted by the ofÏce of Chief Standing Counsel. 3. In view of the order proposed to be passed by this Court, notice to the private-respondent Nos.2 to 6 is dispensed with. 4. By means of the instant writ petition, the petitioner seeks the following reliefs :-
"(a). Issue a writ, order or direction in the nature of mandamus commanding the opposite party no.1 to take the objection and decide it as per law, in the interest of justice. (b). Any other order or direction which this Court deem fit and proper under the circumstances of the case in favour of petitioner be passed in the interest of justice."
5. It is the case of the petitioner that the petitioner has filed his objections under Section 9- A (2) of the U.P. Consolidation of Holdings Act, 1953, alongwith an application seeking condonation of delay. However, the said objections have not been received nor entertained by the Consolidation OfÏcer and it is in the aforesaid compelling circumstances that the petitioner has approached this Court. 6. Dr. Krishna Singh learned Standing Counsel has pointed out that in so far as the consolidation operations are concerned, the same came to be closed upon Notification made under Section 52(1) of the Act of 1953 on 31.5.2010. It was put to the learned counsel for the petitioner as to whether he was aware of the fact that the consolidation proceedings have been denotified on 31.5.2010 to which he submits that he does not dispute this fact. In view thereof, the petition as well as the prayer made by the learned counsel for the petitioner is completely misconceived. The petition is dismissed. However, this dismissal shall not be construed as an expression of opinion on the merits of the matter and in case if any remedy is available to the petitioner, he may exercise the same in accordance with law.
