Heard learned counsel for the parties and perused the record. Present petition has been filed with the following prayers :- i. Issue a writ, order or direction in the nature of certiorari for quashing of the First Information Report dated 06.7.2024 bearing FIR no.204/2024, under Sections -419, 420, 467, 468, 471, IPC, Police Station – Risia, District – Bahraich, (contained in Annexure no.1), annexed with the present writ petition). ii. Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties concerned not to arrest the petitioner on the basis of impugned First Information Report dated 06.7.2024 bearing FIR No.0204/2024, under sections- 419, 420, 467, 468, 471, police station – Risia, District Bahraich (contained in Annexure no.1), annexed with the writ petition).” It has been submitted by the learned counsel for the petitioner that the petitioner is not named in the FIR and has been deliberately harassed by the police. The counsel for the State – respondent has produced before this Court instructions sent by Shri Shailendra Kumar, Sub Inspector, police station – Risiya, District Bahraich wherein it has been stated that a final report no. B-04/2024 dated 19.01.2025 has been prepared and submitted to the C.O. who has remitted the same for further investigation on 28.01.2025 and further investigation is being carried out. Till date the petitioner’s name has not surfaced in the investigation. This petition is disposed of with the liberty to the petitioner to approach the appropriate forum in case he is aggrieved by any action of the complainant or the Investigating OfÏcer.
