PUBLIC PROSECUTOR (AP) The Court made the following Order: This Criminal Petition, under Section 482 of Cr.P.C. has been filed on behalf of the petitioners herein/A1 to A3, to quash the proceedings in C.C.No.1407 of 2022 on the file of the learned IV Additional Junior Civil Judge-cum-Judicial First Class Magistrate, Tirupathi. 2 2. Heard learned counsel for the petitioners herein/A1 to A3 and learned Assistant Public Prosecutor representing the State. 3. Though notice was served on respondent No.2, there is no representation for respondent No.2. 4. Petitioner No.1 and respondent No.2 have arrived at a settlement before the lok adalat at Tirupathi vide Lok Adalat Case Number No.365 of 2022 dated 01.06.2022, wherein respondent No.2 agreed to withdraw the criminal case vide FIR No.34 of 2021, for the offences under Section 498A read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act, registered with the Women Police Station, Tirupati and the petitioners further agreed to withdraw the Transfer Petition No.455 of 2022 on the file of the Hon’ble Supreme Court of India. It was further agreed between the parties that they will not come and interfere in others personal and professional life of parties thereto and the case against respondent Nos.4 and 5 was not pressed therein. 5. Learned counsel for the petitioners appearing through Video Conference would submit that the Police have filed charge sheet on 04.08.2022. Thereafter, the second respondent has not shown any interest to appear before this Court to prosecute the 3 case. He submits that petitioner No.1 and respondent No.2 have also obtained decree of divorce by mutual consent on 24.07.2023. Thereafter respondent No.2 got re-married and is living separately with her family. 6. Considering the submissions made by learned counsel for the petitioners and also by taking on record the copy of Judgment dated 24.07.2023 in F.C.O.P.No.323 of 2022, the proceedings in C.C.No.1407 of 2022 on the file of the learned IV Additional Junior Civil Judge-cum-Judicial First Class Magistrate, Tirupathi against the petitioners herein is hereby quashed. 7. Accordingly, the Criminal Petition is allowed.
