Supplementary affidavit filed on behalf of revisionists in the Court today is taken on record. 2. Heard learned counsel for the revisionists, learned A.G.A. for the State and perused the record. 3. The present revision has been filed against the order dated 21.10.2023 passed by the learned Additional Sessions Judge (Rape cases and POCSO Act), Sambhal at Chandausi in Session Trial No. 57 of 2023 (State vs. Ritesh Sharma and others), arising out of Case Crime No. 107 of 2021, under Sections 498A, 323, 506, 376, 377 I.P.C. and Section 3/4 Dowry Prohibition Act, P.S. Mahila Thana, District-Sambhal, by which the discharge application moved by the revisionist has been dismissed. However, learned counsel for the revisionists has submitted that charge in the present case has already been framed, hence the present revision has lost its relevance. 4. Believing the statement of learned counsel for the revisionists made at the Bar, the order dated 21.10.2023 passed by the learned Additional Sessions Judge (Rape cases and POCSO Act), Sambhal at Chandausi is concerned, the same has lost its relevance, since the charge has already been framed against the accused persons and the trial is going on. 5. There is no merits in the present revision and the same is accordingly dismissed. 6. However, it shall remain open to the revisionists to seek appropriate remedy at appropriate stage.
