Heard learned counsel for the parties and perused the record. Present writ petition has been filed with the following main prayers :- i. Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties particularly No.2 and No-3 to conduct the fair and proper investigation in the Case Crime No.- 0610/2024, under Sections – 333, 352, 115 (2) / 92 BNS, police Station Dhaurahara, District Kheri. ii. Issue a writ, order or direction in the nature of Mandamus commanding the opposite party no.2 or No.3 to take action against the opposite party no.4 to 7 in according with law, in the interest of justice." Learned counsel for the petitioner states that the petitioner is the complainant and she has apprehension that the police personnel of police station Dhaurahara, Lakhimpur Kheri are colluding with the private opposite parties and to prevent them proper investigation shall not be carried out in the matter, hence, this petition has been filed. Learned A.G.A. on the basis of instructions sent by some Vinod Kumar Dwivedi, Sub Inspector of police station – Dhaurahara District Lakhimpur Kheri wherein it has been stated because no credible evidence has been found and final report no.002/2025 dtd 0712.2025 has been prepared and submitted to the Supervisory Authority -the C.O. Dhaurahara for onward submission to the Court concerned in due course. This petition is disposed of with liberty to the petitioner to file a protest petition before the Court concerned if and when the need arises.
