The writ petition is filed by the petitioner praying for following reliefs:- i) issue a writ, order or direction in the nature mandamus commanding and directing to the respondents concerned to consider and decide the representation dated 25.11.2024 as well as reminder dated 09.01.2025 moved by the petitioner which is still pending before respondents concerned uptill now. ii) issue a writ order of direction in the nature of mandamus commanding and directing/restraining to the respondent no.6 to 8 not to interfere in peaceful use and possession to the petitioner over the 1/2 shares of Gata No.355A/0.0610 and 355B/0.0300 as well as Awadi situated in Mauta Kanti, Tehsil Madiyahu, P.S. Bars, District Jaunpur during the pendency of the partition suit filed by the respondent No.7/Sheshmani before the Sub- Divisional Magistrate, Tehsil Mandiyahu, District Jaunpur." Learned counsel for the petitioner submits that the family members of the petitioner are interfering in the peaceful possession of the petitioner on Gata No.355A/0.0610 and 355B/0.0300. The dispute is between private persons and the remedy lies before the competent civil court/revenue court. The writ petition under Article 226 of the Constitution of India is not maintainable.
