Chaurasiya, Executive Engineer, Provisional Division, Public Works Department, Pratapgarh appear before this Court on 14.02.2025 and justify the order impugned especially in view of the reports contained in Annexure nos.5 and 6, according to which, the two ongoing works had in fact been completed and the third report dated 10.01.2024 which has been placed before us by Sri Sisodiya, learned C.S.c. which is also on the same lines and which we take on record. 3. List this case on 14.02.2025 as fresh. 4. The tender shall not be finalized till next date of listing as prima facie subject to the explanation which may be offered by the said officer, the rejection of tender of the petitioner as non-responsive does not appear to be justified." Today, Shri Rajesh Tiwari, learned Additional Chief Standing counsel has instructions to inform the Court that the impugned tender notice has been withdrawn and fresh tender notice will be issued, therefore, no further proceedings are required.
