Neutral Citation No. - 2025:AHC:50353 Court No. - 6 Case :- WRIT - A No. - 52672 of 2010 Petitioner :- Arvind Kumar Respondent :- State of U.P. and Others Counsel for Petitioner :- Dharmendra Kumar Srivastava,Pulkit Counsel for Respondent :- Vikram Bahadur Singh Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Dharmendra Kumar Srivastava, learned counsel for the petitioner and Sri Hare Ram, learned counsel for the respondents.
2. This writ petition is pending since 2010.
3. Claim of the petitioner for compassionate appointment has rendered infructuous not only on ground that this writ petition is pending for last 15 years, but also taking note that father of petitioner was missing since 21.3.1984 i.e. about more than 41 years and even if it is considered to be a civil death after 7 years though till date no order has been passed by Civil Court, the claim is now sought after thrice and half decade. Purpose of compassionate appointment to tide over immediate financial crisis does not exist at this belated stage.
4. Court also takes note that petitioner is presently aged about 58 years.
5. In the aforesaid circumstances, all the arguments raised by
learned counsel for the petitioner has no legal basis, therefore, this writ petition is dismissed.
