The instant writ petition is directed against the order dated 21.03.2025 issued by the Director of Health Services, Assam i.e. the respondent No.2 herein allegedly proposing to downgrade/revert the petitioner back to the post of Surveillance Worker, that too, without serving any prior notice upon him. Taking note of the grievance expressed in the writ petition, by the order dated 28.05.2025, the learned Standing Counsel, Health Department was granted time to obtain instruction. Today when the matter is called up, Mr. B. Gogoi, learned Additional Advocate General (Health), Assam submits that no action will be taken against the petitioner in terms of the impugned order dated 21.03.2025 without serving a show-cause notice upon him. If that be so, the basic grievance of the petitioner, expressed in the writ petition, appears to have been redressed. Mr. Bhuyan, learned counsel for the petitioner has also fairly agreed to Page No.# 3/3 the same. In view of the above, this writ petition stands disposed of at the stage of motion hearing by taking note of the submission of Mr. Gogoi that no precipitate action in terms of the order dated 21.03.2025 would be taken against the petitioner without serving prior show cause notice upon him.
