During the course of arguments, Ms. Aprajita Bansal, learned Counsel appearing for the opposite parties submitted that she has asked for fresh instructions from the concerned, as the case of the opposite parties is, that in fact, the two premises being claimed by the petitioner are not separate premises, rather their address has changed on paper on account of delimitation, but the premises is one. She has not yet received the instructions and documents in this regard. We are, therefore, of the opinion that a better order, a more reasoned one, with a reference to documents, if any, collected by the opposite parties to demonstrate that there is only one premises of the petitioner and the address of the premises has changed on account of delimitation, taking advantage of it, the petitioner is claiming that there are two premises situated at two different places, meaning thereby, if the stand of the opposite parties is that there is only one premise which is located at a particular place and there is only change of address on the paper, be passed. Let a fresh decision be taken within three weeks. The impugned decision shall abide by the fresh decision to be taken as aforesaid. It is made clear that if in this process it is found that the claim of the petitioner is correct, then the needful shall be done in terms of the earlier order within the same period and the order impugned shall in that eventuality be withdrawn. The writ petition is accordingly disposed of.
