Also heard Mr. Bhaskar Sarma, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This application has been filed under Section 483 of the BNSS, 2023, whereby Page No.# 2/2 the petitioner, namely, Juran Ali has prayed for releasing him on bail, after he was arrested in connection with Hajo P.S. Case No. 178/2025. 3. 12 kgs. of heroin were recovered from the possession of the present petitioner. 4. Mr. Munir has submitted that the petitioner has already spent 53 days in judicial custody. 5. I have considered the submissions made by the learned counsel of both sides. 6. The petitioner is languishing in jail since 22.04.2025. 7. The amount of narcotic drugs seized from the possession of the petitioner is of intermediate quantity. 8. Considering the amount of drugs seized from the possession of the petitioners, which is of intermediate quantity vis-à-vis the period of detention undergone by the petitioner in judicial custody, this Court is of the opinion that the petitioner does not deserve to be detained in custody. 9. Therefore, the bail application of the petitioner is allowed. 10. It is hereby directed that the petitioners namely, Juran Ali, who was arrested in connection with Hajo P.S. Case No. 178/2025, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of learned Special Judge, Amingaon. The bail application is disposed of accordingly.
