2 connection with Crime No.18/2025 registered at Police Station Bhatgaon, District-Sarangarh-Bilaigarh (C.G.) for the offence punishable under Sections 115(2), 296, 333, 351(2) & 3(5) of BNS, 2023. 2. Case of the prosecution, in brief, is that complainant namely Satish Khatkar (Brother-in-law of the applicant) lodged first information report on 29/01/2025 bearing Crime No. 18/2025 alleging that on the date of incident i.e. 27/01/2025 his brother-in- law namely Lakshmikant Lahre alongwith the present applicant went to paternal house where the wife of the applicant's brother is residing, due to some matrimonial dispute on account of which the wife of the applicant's brother had lodged first information report (F.I.R.) against her in-laws including the present applicant for offence under section 498-A of the Indian Penal Code and therefore the applicant on the date of incident went to their house where they abused and beaten by hands and fists the complainant and forced them to take back the complaint. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He further submits that the other co-accused person namely Laxmikant Lahre has already been granted anticipatory bail by this Court in MCRCA No.278 of 2025 vide order dated 25/02/2025. Therefore, he submits that the present applicant is
3 also entitled to be released on anticipatory bail on the ground of parity. 4. On the other hand, learned State counsel as also learned counsel for the complainant has opposed the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6.
Considering the facts & circumstances of the case and also the fact that other co-accused person namely Laxmikant Lahre has already been granted anticipatory bail by this Court in MCRCA No.278 of 2025 vide order dated 25/02/2025, therefore, I am inclined to grant anticipatory bail to the present applicant on the ground of parity. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Kamalkant Lahre, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) He shall appear before the trial Court on each and every date given to him by the said Court till
4 disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
