Heard the learned counsel for the Petitioner and learned Assistant Public Prosecutor for the respondent. 2. Learned counsel for the `petitioner Submits that the Petitioner iS arraigned as Accused No.3 in Crime No.4 of 2025, on the file of Vidapanakal police Station, Ananthapuram District, for the alleged offence under Sections 316(5), 318(4) r/w 3(5) of BNS. 3. lt is submitted that the petitioner and two Others have Purchased Chilli from the traders and transported the same to Guntur. lt lls alleged that part of the amount was paid by the petitioner and balance was left which was to be paid. Even as per the complaint, it is stated that, the Petitioner have Stored the chiI'i in cold storage as the rate of chiIIi had drastically fallen. 4.. Learned Assistant Public Prosecutor submits that the petitioner and two others have caused loss {o the farmers, and the farmers are tied, believing the traders, and parted with the chilli in the hope of receiving payment for the sale. 5. Considering the time that the alleged incidenttoOk Place two years Prior to the date of filing of the complaint, the issue between the petitioner and the traders is with regard to the payment for the chilli purchased by the petitioner along with others, and also considering the submission that the intention of the petitioner is not to defraud or to cheat, but only on account of fall in the price of chilli, the purchased chilli has been stored 'ln the cold storage, the petitioner E=E I- shall be enlarged on bail. in the event of his 'arrest with the following conditions:- (i) The petitioner shall furnish a personal bond for Rs.20,000/- (Rupees twenty thousand only) wlrth two Sureties for like sum each to the satisfaction of station House Officer, Vidapanakal Police Station, Ananthapuram District. (ii) I{ is made clear that the petitioner shall not hamper with the investigation or tamper with the evidences. (iii) The petitioner sha" appear before the concerned station House Officer on every 2nd Saturday, till completion of invest,'gation. 6. With the above conditions, the criminal petition is allowed.
