In view of order being passed, notice to opposite parties 5 to 16 stands dispensed with. Petition has been filed seeking a direction to the concerned authorities for removal of alleged illegal encroachment by opposite parties 5 to 15 in gata No. 737-M/0.427 Hectare situated at village Tedwa Basantpur, Tehsil Mahsi, District Bahraich. Learned State Counsel on the basis of instructions submits that proceedings under section 67 of the Revenue Code 2006 have already been initiated and are pending consideration. In view thereof aforesaid submissions, the opposite party No. 3 i.e. Additional Collector/Tehsildar, Tehsil Mahsi, District Bahraich is directed to decide the aforesaid proceedings expeditiously, preferably within a period of eight weeks from the date a certified copy of this order is brought on record of proceedings after affording opportunity of hearing to alleged encroacher and the gaon sabha. The application stands disposed of.
