Petitioners are aggrieved of order dated 24.06.2024 passed by learned Additional Special Mobile Magistrate, Doda [“the trial Court”] vide which closure report filed by Police Station, Doda-respondent No. 1 came to be rejected and remanded for reinvestigation, primarily on the ground that Magistrate is not vested with the jurisdiction to order reinvestigation. 02. Mr. Anirudh Sharma, Advocate vice Mr. Rahul Pant, learned Sr. Advocate for the private respondent has fairly conceded the legal position and has no objection in case the impugned order is set- aside and Magistrate is directed to consider the matter afresh in accordance with law. His statement is taken on record. 03. In view of the above, present petition is allowed and impugned order dated 24.06.2024 is set-aside.
