2.
The petitioner has been made accused in connection with Kasmar P.S. Case No. 04 of 2025, for the offences registered under Sections 103(1) / 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act, pending in the court of Sri Rajesh Ranjan Kumar, learned Judicial Magistrate, 1st Class, Bermo at Tenughat.
3.
On 12.01.2025, unknown criminals shot the son of the informant, namely, Pintu Kumar Nayak, while he was sleeping inside his house.
4.
During course of investigation, it transpired that widow sister-in- law of the deceased has hired criminals for committing his murder due to property dispute. It further appears that co-accused persons were apprehended and, on their confession, murder weapon was recovered from the house of grandfather of the petitioner. Both co-accused persons have confessed that they had shot the deceased.
5.
Learned counsel appearing for the informant has vehemently opposed the prayer for bail and submitted that the petitioner had given firearms to the co-accused persons, as it transpired from their confession. It was further submitted that from the call details of the accused persons, it further appears that the petitioner was talking to the co-accused prior to the occurrence.
6.
Considering the fact that there is no allegation of firing against the petitioner, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Sri Rajesh Ranjan Kumar, learned Judicial Magistrate, 1st Class, Bermo at Tenughat, or his successor, in connection with Kasmar P.S.
