In view of the proposed order being passed, notices to respondent Nos.2 to 4 is dispensed with. Heard learned counsel for the applicant and learned A.G.A. for the State-respondent. This petition is filed with the following main prayer:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to set aside the order dated 06.08.2024 passed by Learned Court of Additional Chief Judicial Magistrate, Court No. 1, Unnao in Criminal Misc. Case No. 1565 of 2023 (contained as Annexure No. 1), in the interest of law and justice." A perusal of the record so also the impugned order show that dispute is primarily civil in nature and no endeavour has been made by the applicant for setting aside the alleged agreement on civil side thus, till such agreement subsist, it has been rightly opined by the learned trial court that no offence is prima facie made out against the accused persons. The petition being devoid of merits and is accordingly dismissed. Order Date :- 5.2.2025 Saurabh Yadav/- Digitally signed by :- SAURABH YADAV High Court of Judicature at Allahabad, Lucknow Bench
