K. Dev Choudhury, learned Deputy SGI for the sole opposite party/NIA. 2) The petitioner, namely, Sri Adhir Das, son of late Dhaneswar Das, resident of Matai Bazar, Balonia, Police Station-Balonia, District-South Tripura has filed this criminal petition under Section 528 BNSS, 2023 on 08.05.2025 praying amongst others, to grant him bail in Special NIA Case No. 01/2024, arising out of NIA Case No. RC-01/2023/NIA/GUW, registered under Sections 120B/121A/153A(1)/ 153B/465/471/295A/109/370 of the IPC read with Sections 12(1)(a)/12(1A)(a)(b)/12(2) of the Passports Act, 1967 read with Sections 17/18/18(B) of the Unlawful Activities (Prevention) Act, 1967, in which he has been shown as accused No. 38 in the supplementary charge-sheet No. SCS No 1(A)/2024 filed on 24.06.2024, showing him as an absconder. 3) During the deliberation of the matter, the learned counsels for the petitioner and the sole opposite party/NIA submitted that barring one accused, the remaining accused persons of the case are on bail and that 17.05.2025 is the date fixed for production of the said accused and 30.05.2025 is the date fixed for adducing of evidence in said Special NIA Case No. 124/2024. 4) Considering the same and as charge sheet has already been filed, including the supplementary charge sheet in said RC-01/2023/NIA/GUW, the petitioner is directed to appear before the Court of the learned Special Judge (NIA), Assam at Guwahati in said Special NIA Case No. 01/2024 on 17.05.2025 and pray before the said authority for his bail in the said case. 5) In the event of filing any such bail application by the petitioner in said Special NIA Case No. 01/2024, arising out of NIA Case No. RC-01/2023/NIA/GUW on 17.05.2025, the learned Special Judge (NIA), Assam at Guwahati shall consider the same, in accordance with law, but securing the attendance of the petitioner, named above, during the trial of said Page No.# 3/3 Special NIA Case No. 01/2024, till its completion. 6) With the above observation, this criminal petition stands disposed of.
