GP FOR REGISTRATION AND STAMPS The Court made the following: 2 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 7493/2025 ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents herein particularly Respondent No.5 in refusing to issue the Market Value Certificate enabling the petitioner for further transactions, pertaining to the petitioner’s property to an extent of 190 Sq. yards situated at Plot No.26, Sy.No.1969-2B of Doddipalli Gram Panchayat, Piler Mandal, Annamayya District Erstwhile Chittoor District without assigning any reasons and procrastinating the same as nothing but illegal, arbitrary and against to the well-established legal principles apart from being violative of fundamental and constitutional rights guaranteed under Articles 14, 21 and 300-A of the Constitution of India and contrary to the provisions of the Registration Act, 1908 and consequently direct the respondent No.5 to issue Market Value Certificate pertaining to the petitioner’s property to an extent of 190 Sq. yards situated at Plot No.26, Sy.No.1969-2B of Doddipalli Gram Panchay, Piler Mandal, Annamayya District Erstwhile Chittoor District forthwith and pass such other order.” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 3. Learned counsel for the petitioner submits that the petitioner being the absolute owner of the subject property made an application to the respondents seeking for issuance of market value 3 certificate, but the respondents not provided the same. Hence, the Writ Petition. 3. On the other hand, learned Assistant Government Pleader for the respondents furnished written instructions dated 02.04.2025 issued by the 5th respondent, wherein it is stated as follows: “In this regard, I submit that the petitioner has not submitted any application requesting to issue market value for the subject property, if, the petitioners submits any application, the same will be issued to him on verification of records available with regard to prohibited properties list under Section 22-A of Registration Act, 1908, temporary injunction orders granted by the Hon’ble Courts and existing market value guidelines register.” 4. Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents and on perusal of the material placed on record, this Court deems it appropriate to dispose of the writ petition directing the petitioner to submit proper application along with required documents to the respondents, within a period of two(2) weeks from the date of receipt of copy of this Order. After receipt of the same, the 5th respondent is directed to consider the said application and furnish the market value certificate, within a period of three(3) weeks thereafter. 4 5. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
