The brief facts of the case are that On 08.02.2025, on receipt ofcredible information about the accused in crime No.09 of 2025, who is no other than the petitioner herein, the complainant Constable by name B.Nagaseshulu along with Inspector of Police by name M.Ramesh- Babu, other Police constables, Home Guard by name T.Ram Mohan and Panchayatdars went near to the Kasturiba School by a private Vehicle i.e., Bolero bearing Reg. No.AP21 CH 2714 as police jeep was under repair ah~d Caught the accused. on enquiry, the accused stated that his followers went near Belum caves by crime vehicle and said that he would show if they gO With 'him. Then, all of them started at 9.10 a.m. and while proceeding tO Belum caves and when they reached near Gas godown on the Outskirts Of Kolimigundla village, the accused suddenly turned outburst saying tO them aS llHow dare, you police would arrest me, I will kill you all" and caused Obstruction from Performing their duties and that with an intention to kill the inmates of Bolero vehicle, at once, the accused stood up from his seat in the backside of the driver and forcibly turned the steering, resulting which the vehicle hit the stones on the left side of the road causing damage to the vehicle and injuries to the inmates. Therefore, the present crime has been registered against the Petitioner. . L=-`~. 4. Heard learned counsel 'fOr the Pet®ltiOner and the learned Assistant public Prosecutor representing the respondent/State. J+- 5. Learned counsel for the Petitioner/accused COntendS that the Petitioner has been in judicial custody from o8.02.2025 and most of the investigation iS ®1 completed, and prays to enlarge the petitioner on bail. 6. Learned Assistant Public Prosecutor opposed tO grant bail to the petitioner on the ground that investigation is not yet completed and there are antecedents against the petitioner. 7. As seen from the record, the Petitioner has been injudiCial Custody from o8.02.2025. As seen from the allegations made, simply because the petitioner alleged to be forcibly turned the Vehicle, it |lS doubtful aS tO the ingredients of an offence under section 109(1) of BNS applies to the Present case on hand as the petitioner was also travelling in the vehicle and if any accident occurred, he will also sustain injuries. 8. Considering the fact that most Of the Witnesses are Official Witnesses, the release of the petit'loner would not cause tampering of evidence and hampering of investigation. As the petitioner has got Permanent abode at Kol'lmigundla Village of Nandyal District, there iS nO possibility Of his flee'lng away from justice. ln view of the same, this Court is 'lnclined to grant bail tO the petitioner with some conditions. r,jlT#=> \ 9. In the result, the criminal Petition is allowed with the following I/ conditions.I (i) The petitioner/accused shall be released on his executing a Personal bond for Rs.25,000/- (Rupees Twenty five thousand only) wl'th two sureties for a like sum each to the satisfaction of the learned Ill AddI-tiOnaI District & Sessions Judge, Kurnool at Nandyal; (ill) On release, the petitioner shall appear before the SDPO, Nandyal once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., for a period of three (3) months; and (iii) the petjtl'oner is directed not to hamper the investigation and tamper with the prosecution witnesses and he shall cooperate with the investi_aation.
