The present writ petition has been filed by the petitioner with the following prayer :- "(i). Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite party No. 2 to 4 to remove the illegal encroachment/construction which has been raised by the private opposite parties nos. 5 to 7 over the land gata No. 089-Min which is recorded as a Rasta/Chakroad in the revenue record of Village- Chandidaspur, Tahsil-Kaiserganj, District-Bahraich and comply with the order dated 30.10.2023 passed by opposite party No. 4, as contained in Annexure No. 4 to this writ petition, in the interest of justice." 3. Learned Standing Counsel based upon the instructions states that the proceedings under Section 67 of U.P. Revenue Code were concluded, however, recall applications filed by the petitioner and others are still pending. 4. In view of the said statement, the present petition is disposed of with a direction to conclude the pending recall applications with all expedition in accordance with law preferably within a period of 90 days.
