Hon'ble Rajeev Singh,J. 1. Heard learned counsel for the petitioner and learned A.G.A. for the State. 2. This petition seeks for issuance of writ in nature of Habeas Corpus commanding the respondents to produce the petitioner/detenue before this Court and set her liberty. 3. In pursuance of the earlier order dated 04.02.2025, written instructions are placed by the learned A.G.A. duly signed by Mr. Ajay Saroj, Sub-Inspector, P.S. Ahirauli, District Ambedkar Nagar dated 11.02.2025 and informs that in the inquiry, the detenue stated that due to victimization of her husband/deponent, she is residing with her parents on her own. The aforesaid written instructions are taken on record. 4. Considering the contents of the petition as well as written instructions, it is evident that the detenue is residing with her parents on her own. 5. In view of above, the petition is misconceived and is hereby dismissed. 6. However, it is open to the deponent to file appropriate application under Section 9 of the Hindu Marriage Act before appropriate court.
