Neutral Citation No. - 2025:AHC-LKO:7348-DB Court No. - 2 Case :- WRIT - C No. - 1046 of 2025 Petitioner :- Abdul Raoof Respondent :- State Of U.P. Thru. Addl. Chief Secy. Revenue Deptt. Lko. And 3 Others Counsel for Petitioner :- Gyanendra Mishra,Anoop Verma Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. The petitioner wants reconstruction of kharanja on Gata No.342 Minjumla of which he is a co-tenure holder. His submission is that the interlocking tiles existing thereon was removed in view of certain orders passed in Writ C No.8707 of 2024, wherein the petitioner who had alleged encroachment on his land bearing Gata No.341. From this khatauni we find that the Gata No.342 is Minjumla land. The other co-tenures have not joined the petitioner, therefore, we cannot consider his request. Even otherwise, without interfering with the bhumidari land in favour of of any other tenure holder, if all the co-tenure holders want some road to be constructed through their land and there is no other legal impediment then they can offer it to the concerned or the petitioner may seek such other remedy as permissible under law but it should not affect any other Bhumidar. The Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 5.2.2025 Saurabh Digitally signed by :- SAURABH VERMA High Court of Judicature at Allahabad, Lucknow Bench
