Neutral Citation No. - 2025:AHC-LKO:8086-DB Court No. - 2 Case :- WRIT - C No. - 1084 of 2025 Petitioner :- Smt.Naraiyan Dei Respondent :- Bharat Petroleum Corporation Ltd. Mumbai Thru Its Chairman And 2 Others Counsel for Petitioner :- Jageshwari Prasad Mathur,Raj Kumar Dwivedi Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1. Heard. 2. The grievance of the petitioner is that a drain runs in front of the land of the petitioner and that of the opposite party no.3, who has been allotted a retail outlet and the location of the retail outlet to be run by opposite party no.3 is just behind the drain. Submission of learned counsel for the petitioner is that if the retail outlet is constructed, then the opposite party no.3 or the oil company will have to cover the drain which is impermissible in law. 3. Let the petitioner inform the opposite party no.3 in writing about any such provision or prohibition and also inform the concerned department or agency which may have a right over the drain under any statute or otherwise, who shall look into the matter and do the needful, as per law. 4. Learned counsel for the petitioner submits at this stage that the petitioner has already moved a representation, but the same has been rejected by the oil company. If such an application/ representation has already been refused by the oil company then the same has not been challenged herein. 5. The writ petition is, accordingly, disposed of with liberty to the petitioner to pursue other remedies, as available to her under law. (Om Prakash Shukla, J.( (Rajan Roy, J.)
