Neutral Citation No. - 2025:AHC-LKO:7412 Court No. - 19 Case :- WRIT - C No. - 1108 of 2025 Petitioner :- Babau Ram Yadav Respondent :- State Of U.P. Thru. Secy. Revenue Lko. And 5 Others Counsel for Petitioner :- Mukul Pandey Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Manish Mathur,J. Heard learned counsel for petitioner, learned State counsel for opposite parties No. 1 to 4 and Mr. Mohan Singh, learned counsel for opposite party No.5. In view of order being passed, notice to opposite party No.6 is dispensed with. Petition has been filed seeking a direction to the concerned authorities for removal of alleged encroachment by opposite party No.6 over Gata No.1421 area 0.0410 hectare regarding to land situated at village Bramadpur Jariyari, Pargana- Akbarpur, Tehsil Bhiti, District Ambedkar Nagar over public pathway. Learned State counsel has been provided written instructions dated 04.02.2025, which are taken on record and as per which, only encroachment over the aforesaid property is by the petitioner himself for which appropriate action is under contemplation. It has also indicated that opposite party No.6 in fact has been granted a residential lease over the property in question and it is in pursuance thereof that the said person has constructed his residence and is living there. It is also indicated that there is no public pathway indicated over the aforesaid plot. Considering the aforesaid instructions, it does not appear to be any occasion to pass an appropriate order in the petition and accordingly the writ petition is disposed of granting liberty to the petitioner to approach the authority concerned under the relevant provision of the Revenue Code, in case so desires.
