Petition has been filed seeking a direction to the concerned authorities for removal of alleged illegal encroachment by opposite party No.6, Mangalk Yadav over gaon sabha property in gata No. 1714 area 0.1008 Hectare situated at village Panchayat Kalepur Mahuwal, Tehsil Jalalpur, district Ambedkar Nagar. Learned State Counsel on the basis of instructions submits that proceedings under section 67 of the Revenue Code 2006 were instituted and were decided ex parte against the alleged encroacher whereafter he has filed an application for recall/restoration which is still pending consideration. In view of aforesaid submissions, the opposite party No. 4 i.e. Tehsildar, Tehsil Jalalpur, District Ambedkar Nagar is directed to decide the aforesaid issue expeditiously, preferably within a period of eight weeks from the date a certified copy of this order is brought on record of proceedings without granting undue adjournments to either parties.
