Neutral Citation No. - 2025:AHC-LKO:7801 Court No. - 7 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 1048 of 2025 Applicant :- Vinay Kumar Singh @ Pappu Singh Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. Counsel for Applicant :- Santosh Kumar Srivastava Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J. 1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 2. The applicant seeks enlargement on bail in FIR No.53 of 2023, under Sections 324, 504, 506, 302 iPC, Police Station Mahruwa, District Ambedkar Nagar. 3. This is the second bail application. The first bail application was rejected vide order dated 09.08.2024 passed in Criminal Misc. Bail Application No.3701 of 2024 mainly on the ground that the two witnesses had assigned the role of using of Banka to the applicant. 4. It is argued by the Counsel for the applicant that subsequently during investigation, the said two witnesses have not supported the prosecution story. The statement is on record. 5. Learned A.G.A. vehemently opposed the bail prayer. 6. Considering the fact that the co-accused has been enlarged on bail and the foundation based upon which the first bail of the applicant was rejected, is vanished in view of the subsequent statements of the eyewitnesses, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed. 7. Let the applicant Vinay Kumar Singh @ Pappu Singh be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of the like amount each to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
