Tiwari and Sri Ram Dayal Tiwari, learned counsels for the opposite party no.2 are not present even when the matter is taken in the revised list. 3. The present revision under Sections 397/401 Cr.P.C. has been preferred by the revisionist- Sunil Agrawal, against the judgement and order dated dated 13.12.2011 passed by 3rd Addl. Chief Judicial Magistrate, Gautam Budh Nagar in case no. 2069 of 2011, under section 138 N.I. Act, P.S. Sector-20, Noida, District- Gautam Budh Nagar, and against the judgement & order dated 20.5.2013 passed by VIth Addl. Sessions Judge, Gautam Budh Nagar in criminal appeal no. 26 of 2011. 4. As per the report dated 29.04.2025 a report has been received from the C.J.M., Gautam Budh Nagar stating therein that the revisionist Sunil Agrawal has died. 6. Perused the said report dated 18.4.2025 of the C.J.M., Gautam Budh Nagar to the said effect which has been sent after due verification. 7. In view of the same, the present revision is dismissed as abated since the revisionist has died. 8. The matter be consigned to records. 9. Office to communicate this order along with the trial court records to District and Sessions Judge concerned within two weeks from today for necessary action.
