This petition has been filed for the following main prayer:- "Wherefore, it is most humbly and respectfully prayed that the Hon'ble Court may kindly be pleased to invoke its inherent powers Under Section 482 Cr.P.C. and quash the impugned order dated 10.01.2025 passed by Addl. Magistrate, Court No.4, Lucknow in leading Complaint Case No. 85696/2021 U/s-138 of Negotiable Instrument Act (N.I. Act), "Arun Kumar Vs. Shiv Pratap Singh relation to Police Station Sarojini Nagar District Lucknow by means of which the learned court below has rejected the application dated 23.10.2024 & 03.12.2024 moved by the petitioner for producing/examination of defense witness, in most arbitrary & illegal manner, as contained in Annexure No.1 to this petition." 4. Perused the record so also the impugned order. 6. Learned trial court while rejecting the application of the applicant has rightly opined that applicant can very well prove his case by filing the certified copies of the passbook as well as copies certified by the Bank Manager. Likewise, the trial court has rightly refused to summon Abhay Pratap Singh, Manager of the restaurant and adequate reasons have been assigned for not summoning him and so far as the summoning of postman is concerned, there appears to be no fault in the impugned order. The parties can very well prove the fact that whether he was residing on the given address or not thus, I find no illegality in the impugned summoning order, petition is devoid of merits and is accordingly dismissed.
