Neutral Citation No. - 2025:AHC-LKO:7319-DB Court No. - 2 Case :- WRIT - C No. - 1030 of 2025 Petitioner :- Jibrail And 2 Others Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Lko And 6 Others Counsel for Petitioner :- Ashish Raman Mishra Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. Petitioners seek disposal of an application submitted by them to the Collector, Bahraich, wherein they have prayed for lodging of an F.I.R. against the persons who have been stated to have illegally dug up a pond on abadi land and also for restoration of the status quo ante. On being asked as to under which provision this application has been submitted, none could be pointed out. The grievance appears to be that the pond is being dug up just in front of the petitioners' house and the abadi land. However, learned Standing Counsel has received instructions from the Sub Divisional Magistrate concerned wherein it has been stated that there is already existing as pond at the place in question, which has only been dug up further and in the operations for preparation of ghrauni and also in the records, it is shown as pond. Without entering into the merits of the application, which cannot be seen under this writ petition moved under Article 226 of the Constitution of India, if the petitioners have any cause or locus standi, they can initiate proceedings under the civil, criminal or revenue law as the case may be for redressal of their grievance. The Writ Petition is disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 5.2.2025 Saurabh Digitally signed by :- SAURABH VERMA High Court of Judicature at Allahabad, Lucknow Bench
