Neutral Citation No. - 2025:AHC-LKO:6682-DB Court No. - 2 Case :- WRIT - C No. - 941 of 2025 Petitioner :- Hazrat Ajmeri Peershah Trust Sadarpur Sitapur Thru Its President Mohd. Ehtisham Respondent :- State Of U.P. Thru Chief Secy. Govt. Of U.P. Lucknow And Ors. Counsel for Petitioner :- Sajjad Husain Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Heard Shri Sajjad Husain, learned counsel for the petitioner and Shri Manish Mishra, learned Additional Chief Standing Counsel for the State. This is writ petition has been filed, inter alia, seeking a writ of mandamus for constituting an Inquiry Committee to investigate the conduct of opposite parties no. 4 and 6. The allegation of demanding bribe and arbitrary detention has been made. If the petitioner believes the allegations to be correct, then, he should have initiated proceedings under criminal law. As regards the illegal detention he can maintain appropriate petition seeking compensation or writ of habeas corpus if detention still continues, especially, as petitioner claims to be in possession of some audio recording in this regard. We do not find it to be a fit case for interference, as, such questions of fact which would require adducing of evidence can not be seen under Article 226 of the Constitution of India. However, our order will not come in the way if the State Government or any Higher Authority wants to get the matter inquired. The writ petition is dismissed in the aforesaid terms. .
