1. Heard.
2. Mr. Rajendra Singh Chauhan, learned Advocate who has appeared on behalf of the person, who, as per his submission, has filed a suit for declaration under Section 144 of the U.P. Revenue Code, 2006, but, has not been impleaded herein as an opposite party. The said suit is pending after having been restored, but, in the meantime, the recorded tenure holder sold the land in favour of the petitioner and the petitioner is, at present, recorded in respect of the said land.
3. We are not concerned with the private dispute between the petitioner and Junaid Siddqui who has filed the proceedings under Section 144 of the U.P. Revenue Code, 2006. We are only concerned with the interference of the police. In this regard, we observe/direct that the police shall come into picture only if there is an apprehension of breach of peace or apprehension of commission of any crime or it is actually committed or there are other valid grounds in any law/statue for their interference, but, without interfering in the civil dispute between the parties. The parties should get their rights, if any, adjudicated before the appropriate Court whether it be before the Civil Court or the Revenue Court as it said that some civil suit is also pending.
4. With these observations, the writ petition is disposed of. [Brij Raj Singh, J.] [Rajan Roy, J.] Order Date :- 31.1.2025 Santosh/- Digitally signed by :- SANTOSH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
