ORDER: rd This Writ Petition has been filed questioning the inaction of the 3 respondent in countersigning the revision of timings of inter-state stage carriage permit No.08/2003-04 in continuance of the Order dated 19.11.2022 passed by the Secretary, State Transport Authority, Bengaluru, Karnataka State in Proceedings
Order No.STA-6/SUB No.161/2021 and in Memo NO.6741615/B1/2022 and the Order passed by the Secretary, State Transport
Authority, Vijayawada dated 22.09.2023 in R.No.6741615/B1/2022, which i affecting the rights of the petitioner, as illegal and arbitrary. IS

Grievance of the petitioner is that the petitioner is an existing inter-state stage carriage operator under Permit No.08/03-04 for plying on the route Bengaluru to Madanapalli and back i.e. two round trips, and the permit is covered under the inter-state agreement entered between the State of Andhra Pradesh and the State of Karnataka circumstances, the existing timings have to be revised required timings of travelling public. Hence, the petitioner filed However, due to changed to update with the an application for variation of condition of permit by way of revision of timings before the State Transport Authority, Bengaluru as it is the original authority which granted the permit.. The State of Karnataka granted necessary permissions to the petitioner and immediately it has to be countersigned by the Government of Andhra Pradesh. As the respondent No.4 rejected the claim of the petitioner, he preferred an appeal before the respondent No.2. Though the appeal has been pending before the State of Andhra Pradesh since 25*'' September, 2023 to give effect to the conditions of inter-state agreement and to countersign the revision of timings made by the State Transport Authority, Bengaluru, the same has not been done till date by the Government of Andhra Pradesh.

Learned counsel appearing on behalf of the petitioner submits that the appeal is pending before the respondent No.3 since 25.09.2023 and almost
3 V two years’ period has lapsed, but till date no orders have been passed on the appeal filed by the petitioner herein. In view of the said reasons, the respondent No.2 - Commissioner, State
4. Transport Authority is directed to pass orders on the appeal filed by the petitioner herein within a period of four (4) weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition is disposed of. No order as to costs. As a sequel thereto. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
