Order 30/04/2025
1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the
order dated 06.03.2025 passed by learned Sessions Judge, Karauli (Raj.) in connection with FIR No.59/2025, registered at Police Station Karauli, District Karauli for the offences punishable under Sections 115(2), 126(2), 109(1), 352, 351(2), 351(3), 324(4), 308(2) of BNS, 2023 (later on Section 3/25 of Arms Act), by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed.
2.
Learned counsel for the accused-applicant submits that no injury of fire arm has been caused to complainant. Learned counsel argues that the charge-sheet for the offence under Section 109(1) of BNS has wrongly been submitted. Learned
[2025:RJ-JP:18144] (2 of 3) [CRLMB-3927/2025] counsel also argues that the accused-applicant was arrested on 24.02.2025 and since then, he is behind the bars. Learned counsel further contends that co-accused-Suresh has already been enlarged on bail by Co-ordinate Bench of this Court in S.B. Criminal Miscellaneous Bail Application No.3595/2025 vide order dated 12.03.2025. Learned counsel prays that trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.
3. On the other other hand, learned Public Prosecutor while submitting the factual report dated 07.04.2025 opposes the bail application, submits that another case has also been registered against the accused-applicant, therefore, the bail application of accused-applicant should be dismissed.
4. Factual report dated 07.04.2025 is taken on record.
5. Heard learned counsel for the parties and also perused the material available on record.
6. Having regard to the facts and circumstances of the case and considering the fact that as per the prosecution case, the allegation against the accused-applicant is of opening fire on the complainant, but no fire arm injury has been caused to the injured and also considering the fact that the accused-applicant is behind the bars since 24.02.2025 as well as considering the fact that charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion on the merits/ demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.
7. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant
[2025:RJ-JP:18144] (3 of 3) [CRLMB-3927/2025] Ajit @ Amit @ Chhotu @ Chilav S/o Shri Hariram, arrested in FIR No. 59/2025, registered at Police Station Karauli, District Karauli shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
