In view of order being passed, notice to opposite party No.6 stands dispensed with. Petition has been filed seeking a direction to the concerned authorities for removal of alleged illegal encroachment by opposite party No.6 upon gata No. 186-Ka/0.0120 Hect and gata No.186-Kha/2.2940 Hect. situated at village Mayi Dubey (Lakhanipur), Pargana, Tahsil and District Gonda. Learned State Counsel on the basis of instructions submits that proceedings under section 67 of the Revenue Code 2006 are already pending in the aforesaid aspect and decision shall be taken shortly. In view of aforesaid, the opposite party No. 4 i.e. Tehsildar, Tehsil Gonda, District Gonda is directed to take a final decision in the proceedings under Section 67 of the Revenue Code, 2006 expeditiously preferably within a period of eight weeks from the date a certified copy of this order is brought on record of proceedings after affording opportunity of hearing to the alleged encroacher and the gaon sabha as well.
