“In view of the foregoing discussion, the Writ Petition is allowed, by directing respondent NOs.3 to 7, to take the unofficial and restrain appropriate action respondents from cultivation of Aguaculture farms respect of the lands in Sy.Nos.61, 62, 66, 486/1, 487/1, and 490/1 of Vinnakota Village, Gudlavalleru in 489/1 Mandal, Krishna District, in accordance with law, within a period of six(6) weeks from the date of receipt of copy of this Order. It is needless to observe that the respondent Nos. 3 to 7, conduct Joint Survey or physical verification nature of land and encroachment of shall regarding the Government lands, by the unofficial respondents as observed above. There shall be no order as to costs. 3. Learned counsel for respondent No.4 filed detailed counter-affidavit issued notice dated 27.02.2024 to the petitioner. But stating that the respondents the petitioner refused to the petitioner through registered post, but the same was take the said notice. The respondents sent the notice to returned as ‘unclaimed’. 4 The petitioner is deliberately avoiding the Joint Committee Inspection with a mala fide intention to drag the matter. Thereafter, the respondents the petitioner through Re-survey Team whatsapp group. The petitioner admitted in his representation dated 04.03.2024 that served the notice to was also he received the notice through Whatsapp. In the said representation, it is also stated that due to the threat, the petitioner did not attend the joint committee inspection on 05.03.2024 and requested to arrange police protection for attending the same. The respondents arranged the police protection and informed the same to the petitioner. Even though the respondents arranged police protection, the petitioner did not choose to attend the joint committee inspection. All the other parties who are concerned and who was issued notices in respect of the subject survey numbers have attended the joint committee inspection. The petitioner neither attended nor sent his representative to attend the joint committee inspection. After notice served in all means none of the material evidence has been received from the petitioner. 4.
Upon hearing, both the learned counsel and on perusal of the counter affidavit and material placed along with the counter-affidavit, which indicates that the respondents conducted joint survey and inspection on 05.03.2024 in respect of the subject lands as directed by this Court. It is further observed that for one or the other, the petitioner did not attend the joint committee inspection and survey conducted by the respondent in compliance of the orders of this Court. In reason view of the clear and categorical submissions made by the 4 respondent, the orders of this Court th are complied with. If any grievance still
5 !r subsists, as alleged by the learned counsel for the liberty to proceed further in accordance with law. 5. With the above observations, the Contempt Case is closed. No order petitioner, the petitioner is at as to costs.
