Neutral Citation No. - 2025:AHC-LKO:7362 Court No. - 8 Case :- WRIT - B No. - 101 of 2025 Petitioner :- Kashmeer Singh Respondent :- State Of U.P. Thru. Revenue Secy., Lko. And Others Counsel for Petitioner :- Smt. Shikha Srivastava,Abhinav Pankaj,Avneet Singh,Khushboo Bajpai Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent nos.1 to 3 has been accepted by the ofÏce of learned Chief Standing Counsel. Shri Dilip Kumar Pandey, Advocate has accepted notice on behalf of respondent no.4. Under challenge is the order dated 7.10.2024 passed by respondent no.2 whereby the revision preferred by the private respondent has been entertained and while issuing notice to the respondents in the revision, the operation of the impugned order has been stayed. Submission of learned counsel for the petitioner is that there was no application for interim relief filed separately with the memo of revision and in absence thereof, the revisional court was denuded of jurisdiction to pass any interim order. It is further urged that the order impugned is bad in the eyes of law. Having considered the aforesaid submissions and from perusal of the material on record, a specific query was put to learned counsel for the petitioner as to whether he has put in appearance before the revisional court to which he submitted that he was served with the notice in the month of December, 2024 and since the matter was listed before the revisional court on 13.1.2025 but the members of the Bar were abstaining from judicial work, hence he has not put in appearance. Considering the facts and the circumstances and noticing that the revision is pending before the
respondent no.2 where it is always open for the petitioner to file his objections and bring on record the facts as he wishes to do so before the revisional court. This Court is not inclined to entertain the petition at this stage leaving it open for the petitioner to raise his objections before the court concerned and needless to say in case any such application is moved, the same shall be considered by the court concerned on its own merits in accordance with law. The petition is disposed of in aforesaid terms.
