Order No.02 Dated-08-05-2025
Heard the parties.
The petitioner has been made accused in connection with S.T. Case No.93 of 2023 arising out of Raj Nagar P.S. No.11 of 2023 registered for the offence punishable under Section 302, 307, 326 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed murder of a seven years old boy namely Ganesh Mahto by assaulting him with sabbal(crowbar). It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner has been in custody since 24.02.2023 as mentioned in para-14 of the instant bail application. It is further submitted that the petitioner is suffering from mental illness. Hence, it is submitted that the petitioner be released on bail. Learned Addl.P.P. appearing for the State opposes the prayer for bail of the petitioner and submits that keeping in view serious nature of allegation against the petitioner of committing murder of Ganesh Mahto, there is every chance of the petitioner absconding, if released on bail. It is further submitted that the petitioner is a threat to the law and order situation of the locality. Hence, it is submitted that the petitioner ought not to be released on bail. Considering the serious nature of allegation against the above named petitioner and chance of his absconding, if released on bail, this Court is not
inclined to admit the bail of the above named petitioner. Accordingly, the prayer for bail of the above named petitioner is rejected.
