Mr. B.D.Pande, learned counsel for the petitioner. 2. Mr. Ashish Joshi, learned counsel for the Nagar Nigam. 3. The petitioner is aggrieved by the notice dated 20.06.2016 issued by the Municipal Commissioner, Haldwani. 4. It has been informed to this Court by Mr. Ashish Joshi, counsel for the Nagar Nigam that at present the property in question is in possession of the petitioner and earlier eviction suit was filed by respondent no. 2 and 3 but during the pendency of eviction proceeding respondent no. 2 and 3 sold this accommodation to the petitioner. 5. Since there is a new development and the impugned notice is very old one, let Municipal Commissioner, who is present in Court in compliance to the previous order, issue fresh notice to the petitioner in respect of the property in question and then proceed in accordance with law. 6.
