[2025:RJ-JP:15746] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 4235/2025 Akhtar Khan S/o Shri Siddhiki Khan, Aged About 28 Years, R/o Jaisindhar Gaon, Tehsil Sheo, District Barmer, Rajasthan. ----Petitioner Versus 1. State Of Rajasthan, Through Secretary, Department Of Higher Education, Secretariat, Jaipur. 2. Rajasthan Public Service Commission, Through Its Secretary, Ghooghra Ghati, Ajmer. ----Respondents For Petitioner(s) : Mr. Raghu Nandan Sharma For Respondent(s) : Mr. Govind Gupta for Mr. M.F. Baig HON'BLE MR. JUSTICE SUDESH BANSAL Order 08/04/2025 1. Although the matter was listed in the “Orders” category, however, with consent of counsel for both parties, the matter has been heard finally on merits. 2. By way of instant writ petition under Article 226 of the Constitution of India, petitioner is seeking directions to allow him to submit online/ offline application form for the post of Assistant Professor (Botany), pursuant to the advertisement dated 13.12.2024. 3. It is not in dispute that as per the advertisement dated 13.12.2024, the last date for submission of the application forms was 10.02.2025. Petitioner filed instant writ petition on [2025:RJ-JP:15746] (2 of 2) [CW-4235/2025] 12.03.2025 i.e. after expiry of the last cut off date for submission of application forms. 4. Counsel for petitioner is not able to show any case law, of having any legal right in favour of petitioner to seek extension of last cut off date for submission of application form. 5. This Court is of the opinion that the petitioner has filed the writ petition after expiry of the last date of submission of application form and allowing petitioner to submit online/ offline application form at this stage would tantamount to interference in the last cut off date i.e. 10.02.2025. Fixing a cut off date is within the province of respondent-recruitment agency. The legal position is no more res-integra that the cut off date as appointed by the recruitment agency, to submit online application forms, should be honored and should not be lightly disturbed, else the process would become unended. No case is made out by the petitioner to interfere with the cut off date, in exercising the jurisdiction by this Court under Article 226 of the Constitution of India. 6. In such view of the matter, the prayer made by petitioner is not liable to be accepted at this stage and accordingly, the writ petition, being devoid of substance, is hereby dismissed. 7. Stay application and pending application(s), if any, stand disposed of. (SUDESH BANSAL),J Sachin/291
